Overview
As much as Afruna Global Ltd (herein referred to as either "Us", "We" or "Our") marketplace exists to connect vendors/sellers and customers/buyers we cannot guarantee that all warranties and representations and the accuracy of information disclosed to us in relation to the vendor/seller and his/her product and the customer/buyer hence this Disclaimer Policy.
1.0 Scope
1.1 This policy covers all information, warranties and representation made to us by the vendor/seller regarding themselves and their products and any information disclosed to us by the customer/buyer.
2.0 The Disclaimer
2.1 General Disclaimer
2.1.1 As permitted under applicable law to the maximum, we and on behalf of our affiliates information providers or content partners and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the products, information and contents including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice supplied by vendors/sellers, customers/buyers and all other end users.
2.1.2 Without limitation to the above, and mindful of warranties and representations provided by vendors/sellers or any other customer/buyer or end user as to products, information and content, we did not provide any warranty or undertaking, and make no representation of any kind that the products will meet all your requirements, achieve any intended results, be compatible or meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
2.2 Independence of Vendor/Seller
2.2.1 Any vendor/seller using our marketplace is independent of us. The contract between us and the seller does not establish agency relationship, mandate, agency or employment relationship between the parties.
2.3 Products
2.3.1 All products are marketed on the marketplace and belong to Afruna Global Ltd and/or the vendors/sellers. We shall not be liable for:
a. infringed copyright, trademarks, industrial designs and/or trade secrets owned by vendor/seller or of any made in Africa products or products with an African behind the brand;
b. counterfeited or pirated products on the marketplace particularly but not limited to products belonging to or owned by vendor/seller, or breach of any anti-counterfeit legislation(s) applicable in any territory;
2.4 Content and Information
2.4.1 We will not be liable for any content and information on our marketplace by a vendor/seller or end user under the following:
a. who engages in an unauthorized copying, distributing, transmitting, posting, linking, deep linking, or modifying of this website or any of related websites, applications, services, mobile apps and tools without the express written permission of the company;
b. for any errors, inaccuracies, omissions, or other defects in, or untimeliness or inauthenticity of, the information contained within this website or any of related websites and mobile applications;
c. any content that an user, subscriber, or an unauthorized user may post on this website or any of its sister websites and any content that is posted or uploaded or that is or may be deemed unsuitable can and may be taken down;
d. responsible for the accuracy or reliability of any opinion, advice, or statement made on our websites or mobile application unless expressly given us;
e. loss or damage caused by an end user's reliance on information obtained through this website or any other medium from the opinions and judgments of the independent information provider, end user, or other user not under contract or other obligations with us;
f. for any defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with end user;
g. Nor will our affiliates, information providers or content partners be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within this website or any of related websites, applications, services, mobile apps and tools, or for any delay or interruption in the transmission thereof to the end user.
2.5 Third Parties/Partners
2.5.1 We will not be liable for any third-party information or content on our website or mobile application we are not under any contract with nor liable for any third-party claims or losses of any nature, including without limitation to loss of profits, punitive or consequential damages.
2.5.2 The above provision in 2.4.1 also applies to any of our affiliates, information providers or content partners, none shall be liable to any third-party not any third-party claims or losses of any nature, including without limitation to loss of profits, punitive or consequential damages.
2.6 Transactions
2.6.1 We will not liable for any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behaviour, negligence, or under any other cause of action while handling orders, deliveries, account maintenance, payments and the entire chain of the transactions.
2.6.2 We will not be liable for any transactions or any activity on our marketplace arising out of any failure to keep your password confidential, and that you may be held liable for any losses arising out of such a failure.
2.6.3 We will not be liable for any transaction outside our marketplace between a customer/buyer and a vendor/seller.
2.6.4 The above provisions in 2.6.1, 2.6.2, 2.6.3 also applies to any of our affiliates, information providers or content partners, none shall be liable for the aforesaid.
2.7 Miscellaneous
2.7.1 Note that some territories do not allow for some of the clauses contained in the policy to apply to their citizens but in territories where the clauses set forth in the policy apply, these clauses shall be applied to the greatest extent enforceable under applicable law.
